The decision of the Competition Board concerning this investigation was delivered to Turkcell on August 1, 2001. The Competition Board stated in its decision that Turkcell has a dominant position in the Turkish mobile market. In addition, the report stated that Turkcell violated certain provisions of the Law on the Protection of Competition. As a result of these violations, the Competition Board fined Turkcell approximately $5.2 million and ordered Turkcell to cease violating the provisions of the Law on the Protection of Competition.
Turkcell announced in a company statement that it believed that it had not violated the provisions of the Law on the Protection of Competition, and planned to initiate a cancellation action against the decision of the Competition Board before Danistay, the highest administrative court in Turkey.
