Irvine, California-based Western Digital Corp reports that the court denied a motion by Conner Peripherals Inc for a preliminary injunction in Conner’s infringement suit against Western Digital: Conner had sought the preliminary injunction, claiming that its patents covered Western Digital’s one platter and two platter 170Mb and 340Mb 3.5 Caviar disk drives – Conner had argued that it had been harmed because Western Digital had been able to beat Conner to the market for these drives by nine months to a year, and that Western’s alleged use of three Conner patents would continue to cause irreparable harm; the court denied Conner’s motion on numerous grounds, including that Conner had failed to establish probable success on any of the claims; Western Digital notes that it has a patent counter-suit against Conner pending in central district court.
