BlackBerry has won a lawsuit against one of its top executives to stop him moving to Apple before his notice period expires.
The Ontario Supreme Court ruled that Sebastien Marineau-Mes breached the terms of his employment contract when he left BlackBerry for Apple less than half a year after being promoted.
Marineau-Mes had been in discussions to depart from BlackBerry since September last year, and the iPhone maker offered him the position of ‘vice president of Core OS’ in December 2013.
However, the court took the view that Marineau breached the terms of his employment contract when he left to work at the iPhone maker and ordered him to stay at BlackBerry until June 23.
It rejected his arguments that the contract signed by him was ‘not valid or enforceable’.
The Canadian smartphone maker said in a statement: "It is unfortunate that we had to take this step, but we will do whatever is necessary to ensure that employees honour the agreements they make with us.
"We are pleased that the court has endorsed our position and ruled that the employee contract and its terms are valid."
